I was admitted to the practice of law by the California State Bar in 1989. I am a certified legal specialist in workers’ compensation law. I am also an Arbitrator for the San Diego County Bar Association, where I decide fee disputes between lawyers and their clients. I have served as a volunteer judge for the San Diego Superior Court, hearing small claims cases. I have previously served as a volunteer judge for the Workers’ Compensation Appeals Board. In addition, I am a mediator for the United Food and Commercial Workers Labor Union. In the past, I was President of the San Diego Chapter of the California Applicants’ Attorneys Association, which is a lobbying organization supporting the rights of injured workers.

I have given seminars for legal education courses on the subject of physician cross-examinations in workers’ compensation cases. Over the course of more than 30 years as an attorney, I know there is a right way and wrong way to do things. I have taken many workers’ compensation and some civil personal injury cases to trial. In workers’ compensation cases, trials are presented to an administrative law judge only. Civil injury trials are argued before a judge and most often, a jury.

On a daily basis, I put forth my best efforts to protect my clients to the fullest extent of the law. I accomplish this by developing a specific game plan for each and every client. California workers’ compensation laws were designed to benefit the injured worker. Unfortunately, this isn’t always reflected in reality. Clients are usually confused between pain and suffering, disability, impairment and damages, and which of those concepts even apply in a work injury claim. I will do my best to cover these concepts in this book.

The purpose of this book is to give the reader an inside view into the nuts and bolts of a workers’ compensation claim. It is not meant to be an exhaustive or complete analysis or even a “how-to” book. Life is very short to begin with, and many clients would be much happier, and their cases would go much smoother if they spoke with and even hired an attorney early on in the process. Attorneys can sometimes prevent dire mistakes from happening, instead of trying to fixing the problem once it has happened. Try to think of us as no different from a doctor, mechanic, chef, or computer repair person as you read through this book. An ounce of prevention is definitely worth a pound of cure in many instances. We also know where the land mines and dead bodies are buried.
