This book deals with various aspects of civil litigation, anything from personal injury to real estate business transactions, insurance bad faith, or anything in regards to civil litigation. In any civil litigation case, you need to first look at what the liabilities are. Is the defendant liable? You look at the evidence and ensure there is liability, and that you can connect it to the right people, who are the defendants. Once there is liability, then you must see if there are damages. Have the plaintiffs suffered any damages? If so, what are they? In a business case you look at what kind of loss—loss of future income, past income, or loss of investment. You have to see what the person lost to see if there are damages, and then move on to causation. Then you need to understand if there is liability there, and if someone is liable. There are damages, but was the person’s action the cause of the damages? That is always the hardest part.
