Documenting Damages In Personal Injury Cases

Rehabilitation experts play an important role in assisting the plaintiff and defense attorney in documenting vocational and life care plan damages in cases of serious injuries involving both adults and children.

The lifetime costs of care are substantial in cases involving severely disabled individuals, and their documentation by a comprehensive life care plan that includes loss of earning capacity should not be overlooked. Unfortunately, many attorneys under-utilize these services in many permanently injured cases, thus not fully documenting the economic damages. The experience and expertise brought to a case by a rehabilitation expert will help to ensure the case damages are fully documented and may move the case toward a settlement or jury verdict.

This text will help plaintiffs and defense attorneys better understand what rehabilitation experts (i.e. vocational experts and life care planners) do and how they should be utilized in personal injury cases. The information in this writing is based on my almost 50 years of forensic experience, resulting in some of the largest personal injury verdicts in the United States.
